Class Action Lawsuit

Somewhere along the way since I owned my BZ4X, I have gotten myself involved with a class action lawsuit against Toyota in regards to the 12V battery problems. I just signed on to be a plaintiff with Shub Johns & Holbrook LLP. I have gone through three 12v batteries and have had to jump my car at least 7 times. They are going on there is a defect in the car and Toyota knows it. So we are sueing them.

EV's have a history of eating 12V batteries, especially those that are driven in hot climates like CA, AZ, NM, and TX. From experience in AZ, even my gas/diesel vehicles have had batteries that have had to be placed on an almost annual basis. In Phoenix, Costco puts their car batteries at the front of the store for a reason...batteries are replaced often.

Given this, and that batteries by design are consumables, I think the lawsuit would have more chance of success suing all EV manufacturers and/or the patent holder of the components / technology in how the 12V battery integrates with the rest of the EV. I mean, proving that Toyota alone "knew" there was a defect in their EV while selling a fraction of all EVs in the mix is a longshot.
But hey, good luck! People do win the lottery every day so who knows.

The point of a class action lawsuit is to get resolution for a defect with the product. How is this defect defined?

In other words, how do you prove there is a design or manufacturing mistake when there are so many who haven't ever exhibited any symptoms? What evidence has been provided to justify a large-scale response? The problem may really only qualify for lemon-law instead.
